Hammacher Schlemmer ("Hammacher Schlemmer", "we", "us", "our") welcomes you ("you" or "your"). Hammacher Schlemmer and/or its subsidiaries and affiliates owns and operates this website and all associated sites linked to hammacher.com (collectively, the "Site"), and by visiting, using, or purchasing from the Site you agree to these Terms of Use ("Terms"). If you don't agree, don't use this Site.

Hammacher Schlemmer reserves the right at any time and at our sole discretion to change, modify, add or remove portions of these Terms without prior notice. It is your sole responsibility to review these Terms of Use prior to using the Site, and your continued use of the Site following any change indicates your acknowledgment of and consent to the changes.

All text, graphics, logos, button icons, interfaces, images, videos, sounds, music, artwork and computer code (collectively, "Content"), including but not limited to the design, arrangement, compilation, expression, and "look and feel" of such Content, is Hammacher Schlemmer's property and is protected by United States and international intellectual property laws, including copyright, trademark, and trade dress. You may not copy, republish, reproduce, transmit, reverse engineer, or in any way exploit any part of the Site or Content for any commercial purpose without Hammacher Schlemmer's prior written consent.

You may post or submit comments, reviews, ideas, questions, images, photos, and other content so long as the content complies with the law and with these Terms. You grant Hammacher Schlemmer a nonexclusive, perpetual, irrevocable, royalty-free, sub-licensable right to use, reproduce, publish, distribute, display, modify, and adapt any content you post or submit. Hammacher Schlemmer reserves the right (but not the obligation) to edit or delete any content you post or submit.

No unlawful or prohibited use. You may not use the Site in any manner that (is):

  • libelous, defamatory, abusive, threatening, hateful, harassing, obscene, pornographic, or otherwise violative of any law or right of any third party;
  • infringes, reveals, or otherwise violates any intellectual property, copyright, trademark, or trade secret of any third party;

This Site may contain links to other websites ("Linked Sites") that are not under Hammacher Schlemmer's control. Hammacher Schlemmer is not responsible for, and does not endorse, any content, information, or material at any Linked Sites.

Purchases

Hammacher Schlemmer may make changes to any products or services offered on the Site, or to the prices thereof, at any time, without notice. Hammacher Schlemmer does not warrant that product descriptions or related content are complete, accurate, reliable, or error-free. Title and risk of loss for any items you purchase pass to you upon our delivery to a common carrier. We do not guarantee arrival dates or times for any purchases. You are responsible for any foreign transaction or other processing fee your financial institution may charge for processing your payment. Hammacher Schlemmer DOES NOT PROMISE THAT THE SITE OR ANY CONTENT, SERVICE OR FEATURE OF THE SITE WILL BE ERROR-FREE, UNINTERRUPTED, OR FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS. THE SITE AND ITS CONTENT ARE DELIVERED ON AN "AS-IS" AND "AS-AVAILABLE" BASIS. Hammacher Schlemmer DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING, BUT NOT LIMITED TO, WARRANTIES OF ACCURACY, NON-INFRINGEMENT, MERCHANTABILITY, AND FITNESS FOR A PARTICULAR PURPOSE. Hammacher Schlemmer WILL NOT BE LIABLE FOR ANY DAMAGES OF ANY KIND ARISING FROM YOUR USE OF THE SITE OR ITS CONTENT OR ANY LINKED SITE, INCLUDING BUT NOT LIMITED TO DIRECT, INDIRECT, INCIDENTAL, PUNITIVE, AND CONSEQUENTIAL DAMAGES. Trademarks

Hammacher Schlemmer, and other Hammacher Schlemmer trademarks, service marks, and product and service names are Hammacher Schlemmer trademarks or registered trademarks in the United States and in other countries (collectively, "Hammacher Schlemmer Marks"). In addition, graphics, logos, and icons are trademarks or trade dress of Hammacher Schlemmer in the U.S. and other countries. Hammacher Schlemmer's trademarks and trade dress may not be used in connection with any product or service that is not Hammacher Schlemmer's or in any manner likely to cause confusion among customers. All other trademarks not owned by Hammacher Schlemmer that appear on the Site are the property of their respective owners.

Copyright

If you believe that your work has been copied and is accessible on the Site in any way that constitutes copyright infringement, please send a notice containing the following information to the address listed below:

  • Identification of the work or material being infringed.
  • Identification of the material that is claimed to be infringing, including its location, with sufficient detail so that Hammacher Schlemmer is capable of finding and verifying its existence;

Mobile Messaging Terms of Service

The Hammacher Schlemmer mobile message service (the "Service") is operated by Hammacher Schlemmer ("Hammacher Schlemmer", "we", or "us"). Your use of the Service constitutes your agreement to these terms and conditions ("Mobile Terms"). We may modify or cancel the Service or any of its features without notice. To the extent permitted by applicable law, we may also modify these Mobile Terms at any time, and your continued use of the Service following the effective date of any such changes shall constitute your acceptance of such changes.

By consenting to Hammacher Schlemmer's SMS/text messaging service, you agree to receive recurring SMS/text messages from and on behalf of Hammacher Schlemmer through your wireless provider to the mobile number you provided, even if your mobile number is registered on any state or federal Do Not Call list. Text messages may be sent using an automatic telephone dialing system or other technology. Service-related messages may include updates, alerts, and information (e.g., order updates, account alerts, etc.). Promotional messages may include promotions, specials, and other marketing offers (e.g., cart reminders).

You understand that you do not have to sign up for this program in order to make any purchases, and your consent is not a condition of any purchase with Hammacher Schlemmer. Your participation in this program is completely voluntary.

We do not charge for the Service, but you are responsible for all charges and fees associated with text messaging imposed by your wireless provider. Message frequency varies. Message and data rates may apply. Check your mobile plan and contact your wireless provider for details. You are solely responsible for all charges related to SMS/text messages, including charges from your wireless provider.

You may opt out of the Service at any time. Text the single keyword command STOP to the number from which you receive our messages, or click the unsubscribe link (where available) in any text message, to cancel. You'll receive a one-time opt-out confirmation text message. No further messages will be sent to your mobile device unless initiated by you. If you have subscribed to other Hammacher Schlemmer mobile message programs and wish to cancel, except where applicable law requires otherwise, you will need to opt out separately from those programs by following the instructions provided in their respective mobile terms.

For Service support or assistance, text HELP to the number from which you receive our messages, or email support@hammacher.com.

We may change any short code or telephone number we use to operate the Service at any time and will notify you of these changes. You acknowledge that any messages, including any STOP or HELP requests, you send to a short code or telephone number we have changed may not be received, and we will not be responsible for honoring requests made in such messages.

The wireless carriers supported by the Service are not liable for delayed or undelivered messages. You agree to provide us with a valid mobile number. If you get a new mobile number, you will need to sign up for the program with your new number.

To the extent permitted by applicable law, you agree that we will not be liable for failed, delayed, or misdirected delivery of any information sent through the Service, any errors in such information, and/or any action you may or may not take in reliance on the information or Service.

General

The Terms constitute the entire agreement between you and Hammacher Schlemmer. By using the Site, you agree that all matters relating to your use of the Site, including all disputes, will be governed by the laws of the United States and the State of Texas. You agree to the personal jurisdiction by and venue in the federal and state courts of Dallas, Denton, or Collin County, Texas, and waive any objection to such jurisdiction or venue. Hammacher Schlemmer reserves the right to make changes to the Site, Privacy Policy, and these Terms at any time, without notice. If any of these conditions shall be deemed invalid, void, or unenforceable, that condition shall be deemed severable and shall not affect the validity and enforceability of any remaining condition. Hammacher Schlemmer's failure to insist on or enforce strict performance of these Terms shall not be construed as a waiver by Hammacher Schlemmer of any provision or any right it has to enforce these Terms.
